Definition of manslaughter is a form of homicide in which the defendant knowingly or intentionally causes the death of a person under certain circumstances.

According to the American Law Institute, a second degree manslaughter conviction is a conviction for homicide, but with the added element of a lesser degree of culpability. Meaning, the defendant did something more egregious than knowing or intentional murder.

In general, there are three levels of culpability. The most serious offenses are 1st degree murder, 2nd degree murder, 3rd degree murder, and manslaughter. The difference between the three is that manslaughter can be found in certain cases where a person’s conduct was intentional, but only in a lesser degree of culpability than first-degree murder (a homicide).

The manslaughter that people tend to lumped together is the second-degree offense, meaning that the defendant committed manslaughter but there wasn’t a conscious mouthing of a killing. The second-degree offense usually occurs after a murder, and is sometimes called an “after the fact” manslaughter because it’s an offense that occurs after the fact of the homicide.

It’s a bit of a stretch to call it a homicide because it seems to be more of a case of an accident in which someone was killed in a way they didn’t want to happen. The most commonly cited example of a second-degree manslaughter is the case of a drunk driver who kills a pedestrian who was crossing the street in front of them. In some states, drunk drivers are eligible to get this kind of homicide reduced to manslaughter.

I dont feel that I have to worry about “the consequences of doing the right thing.” I think I will, because there are consequences that are pretty clear. But if I get in a car accident, I am responsible for what happens to me. I get drunk, that is my fault. I get in a serious accident, that is not my fault, as I was not at fault. I have to be more aware of the consequences of what I am doing when I get drunk.

When you drink, you drink. You do not think about that afterwards. I don’t feel that I am responsible for the consequences of what I am doing afterwards either. I have to be more aware of the consequences of what I am doing again, in the future, and decide if I am going to drink and drive. I am responsible for my actions in the present, but I am not responsible for them in the future.
